These Terms of Service ("**Terms**") govern your use of **bin.md** (the "**Service**"), operated by **GRiTT Information Services LLC, a Virginia limited liability company** ("**we**," "**us**," or "**our**").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

For related documents, see our [[:privvy|Privacy Policy]], [[:cookie|Cookie & Storage Policy]], [[:dmca00|DMCA Policy]], and our stance on free expression in [[:freedm|Freedom]].

## Acceptance of terms

By creating an account or using bin.md in any way, you confirm that you have read, understood, and agree to these Terms. We may update these Terms from time to time. Material changes will be announced in the Service or by email; the "Last Updated" date at the top reflects the most recent revision. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

## Eligibility

You must be at least 18 years old to use bin.md. By using the Service, you represent and warrant that you meet this requirement. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

## Accounts

To access certain features, you must create an account through our authentication provider, **Clerk**. Sign-in currently supports email/password. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us at [support@bin.md](mailto:support@bin.md) if you suspect unauthorized access.

## User content and ownership

You retain full ownership of any content you paste or publish through bin.md ("**User Content**"). By submitting User Content to the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, transmit, and index that content solely for the purpose of operating and providing the Service and complying with legal obligations. This license ends when you delete your content or close your account, subject to reasonable technical delays (e.g., backups and 30-day deletion window described in the [[:privvy|Privacy Policy]]).

You are solely responsible for your User Content and the consequences of sharing it. We do not endorse, verify, or take responsibility for User Content posted by others. See [[:freedm|Freedom]] for our position on hosting expression.

## Collaborators, sharing, and public documents

bin.md lets you grant other users **read** or **write** access to documents you own. Grantees with access can view your document even if it is marked private or password-protected, and grantees with write access can publish new versions attributed to you. Managing these grants is your responsibility.

Documents you make public are indexed for search and may be crawled by third parties. Once content is public, we cannot guarantee it has not been copied or cached elsewhere.

## API, OAuth, and MCP access

bin.md is an OAuth 2.1 authorization server and exposes an API and Model Context Protocol (MCP) surface. You may authorize third-party applications ("**Connected Apps**") to access your account with scoped permissions (`bins:read`, `bins:write`, `bins:delete`, `profile:read`). You are responsible for the apps you authorize; you can revoke any Connected App at any time from your account settings.

Third-party developers who register clients agree, by such registration, to our developer terms (published separately at a future date) and to reasonable rate limits and abuse-prevention measures. Rate limits are enforced per plan tier and may be updated with notice in the Service.

## Anonymous documents

You may publish documents without an account. Anonymous documents are returned with an **admin key** that is the only way to later modify or delete them. The admin key is displayed once at creation — we cannot recover it if you lose it. Anonymous documents are not listed on any profile and cannot be private. You represent that you have the right to publish anonymous content and you accept sole responsibility for it.

## Prohibited content and conduct

You may not use bin.md to post, share, or facilitate:

- **Illegal content** — anything that violates applicable local, state, national, or international law.
- **CSAM** — child sexual abuse material or any content that sexually exploits minors. Such content will be reported to the National Center for Missing & Exploited Children (NCMEC) and preserved as required by 18 U.S.C. § 2258A, without prior notice to the poster.
- **Copyright infringement** — content that violates another party's intellectual property rights. See our [[:dmca00|DMCA Policy]] for the takedown process.
- **Malware and malicious code** — files, scripts, or links designed to harm, exploit, or deceive.
- **Spam** — bulk, unsolicited, or repetitive content submissions with no legitimate use.
- **Abuse of the Service** — attempting to circumvent rate limits, reverse-engineer the platform, mass-collect user data, or interfere with other users' access.

We reserve the right to remove any content that violates these rules without prior notice.

## Paid plans and billing

bin.md is offered at three access levels: **Anonymous**, **Free**, and paid plans (**Plus** and **Pro**).

**Anonymous.** You may publish public documents without an account when we make anonymous publishing available. Each anonymous document is returned with a one-time `admin_key` that is the *only* credential capable of editing, deleting, or adopting the document into an account. **We cannot recover this key if you lose it.** Anonymous documents are always public and are subject to a shorter maximum lifetime than owned documents. bin.md is a passthrough hosting service and accepts no legal responsibility for anonymously-published content. We may disable anonymous publishing at any time, with or without notice.

**Free.** With a free account, you own the documents you create, can edit and re-publish them, and can list them on your profile. Some capabilities — including private documents, password protection, scheduled release, extended or unlimited document lifetime, custom forwarding slugs, image uploads within documents, outgoing webhooks, and view analytics — require a paid plan. Attempts to use a paid capability at the Free tier return an `HTTP 402 PLAN_REQUIRED` error.

**Plus and Pro.** Paid plans unlock the capabilities listed above and provide higher operational quotas. Plus and Pro users may also opt out of AI-assisted features (assistant, editing, semantic search indexing).

The pricing page at [bin.md/pricing](https://bin.md/pricing) is the authoritative source for current numeric quotas and the complete feature list. This section describes the categorical differences that carry contractual weight.

We may from time to time grant discretionary overrides for eligible users (e.g., charity, visionary, or gratis access) at no charge. These are provided at our discretion and may be revoked.

Paid plans are billed through **Clerk Billing**, which uses **Stripe** as its payment processor. By subscribing to a paid plan, you authorize recurring charges to your payment method for the plan you selected. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. We do not offer refunds for partial billing periods unless required by law. If we ever change our billing arrangement, we will notify affected subscribers.

## Account termination

We may suspend or terminate your account at any time, with or without notice, if you violate these Terms or if we determine that your use of the Service harms other users, third parties, or the platform itself. Repeat copyright infringers will have their accounts terminated as described in the [[:dmca00|DMCA Policy]].

You may close your account at any time from your account settings or by contacting [support@bin.md](mailto:support@bin.md). Upon termination, we will delete your account and associated content within 30 days, subject to legal preservation obligations and reasonable technical delays as described in the [[:privvy|Privacy Policy]].

## Feature-specific promises

Some documents carry markers such as `is_permanent`, `is_encrypted`, `views_limit`, `expires_at`, or `release_at`. These behave as described in our documentation and are honored on a best-effort basis on our infrastructure. `is_permanent` reflects our commitment not to delete a document arbitrarily, but does not override account termination, legal removal obligations, or catastrophic infrastructure loss. See the linked documentation for each feature's exact behavior.

## Indemnification

You agree to defend, indemnify, and hold harmless us and our affiliates, officers, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from (a) your User Content, (b) your use or misuse of the Service, (c) your violation of these Terms, or (d) your violation of any third-party right, including intellectual property or privacy rights.

## Disclaimer of warranties

The Service is provided "**as is**" and "**as available**" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

## Limitation of liability

To the fullest extent permitted by applicable law, we and our officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or the Service will not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) US $50.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

## Governing law and disputes

These Terms are governed by the laws of the **Commonwealth of Virginia**, United States, without regard to conflict-of-law principles or the Uniform Computer Information Transactions Act (Va. Code § 59.1-501.1 *et seq.*) to the extent those provisions would displace the parties' agreed terms.

Any disputes arising under these Terms will be resolved exclusively in the **state or federal courts located in the City of Newport News, Virginia**, and you consent to personal jurisdiction in those courts. Nothing in this section prevents either party from seeking small-claims relief in a court of competent jurisdiction where you reside.
