**bin.md** (operated by **GRiTT Information Services LLC, a Virginia limited liability company**) respects intellectual property rights and follows the Digital Millennium Copyright Act ("**DMCA**"), 17 U.S.C. § 512. This policy describes how to report copyright infringement and how we handle such reports.

For related documents, see our [[:termos|Terms of Service]] and [[:privvy|Privacy Policy]].

## Safe harbor and current status

bin.md is a user-generated content hosting platform. We do not monitor or pre-screen the content posted by users. Consistent with the DMCA's safe-harbor provisions (17 U.S.C. § 512(c)), we promptly respond to valid takedown notices by removing or disabling access to allegedly infringing content, and we terminate accounts of repeat infringers.

GRiTT Information Services LLC has designated an agent to receive notifications of claimed infringement with the U.S. Copyright Office (registration number **DMCA-1081294**). You can verify the registration in the [Copyright Office DMCA Designated Agent Directory](https://dmca.copyright.gov/osp/).

## How to submit a takedown notice

If you believe content hosted on bin.md infringes your copyright, send a written notice to our Designated Agent. To be valid under 17 U.S.C. § 512(c)(3), your notice must include:

- **Identification of the copyrighted work** — describe the work you claim has been infringed, or if multiple works are at issue, a representative list.
- **Identification of the infringing material** — provide the specific URL(s) on bin.md where the allegedly infringing content appears, with enough detail for us to locate it.
- **Your contact information** — your full name, mailing address, phone number, and email address.
- **A statement of good-faith belief** — a statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- **A statement of accuracy and authority** — a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
- **Your signature** — a physical or electronic signature of the copyright owner or an authorized representative.

> Mailing address:

> Newport News, VA 23606

We strongly prefer notices sent by email. We will acknowledge valid notices and act on them promptly, typically within 2–5 business days.

## What happens after a notice

Upon receiving a valid takedown notice, we will:

- Expeditiously remove or disable access to the identified content.
- Notify the user who posted the content that it has been removed and provide a copy of the notice (with your contact information).
- Log the notice for our repeat-infringer records.

If a notice is materially incomplete or clearly frivolous, we may decline to act on it and will explain why to the sender.

## Counter-notice process

If your content was removed and you believe the takedown was in error or misidentification, you may submit a counter-notice under 17 U.S.C. § 512(g)(3). Your counter-notice must include:

- **Identification of the removed content** — the specific URL(s) of the content that was removed, as it appeared before removal.
- **Statement under penalty of perjury** — that you have a good-faith belief that the content was removed as a result of mistake or misidentification.
- **Your consent to jurisdiction** — a statement that you consent to the jurisdiction of the Federal District Court for the district where you reside (or, if outside the US, the Eastern District of Virginia), and that you will accept service of process from the original complainant.
- **Your contact information** — full name, mailing address, phone number, and email address.
- **Your signature** — a physical or electronic signature.

Send your counter-notice to:

> Email: [legal@gri.tt](mailto:legal@gri.tt)
> Subject: `DMCA Counter-Notice`

Upon receiving a valid counter-notice, we will:

- Forward it to the original complainant.
- Restore the content within 10–14 business days unless the complainant notifies us that they have filed a court action to restrain the activity.

## Repeat-infringer policy

We track valid DMCA takedown notices per account. Accounts whose content is the subject of multiple valid notices may be suspended or permanently terminated at our discretion. We currently use a "three strikes" guideline as a starting point for administrator review; suspension is a human decision, not automatic.

## CSAM and other severe abuse

Content depicting child sexual abuse material (CSAM) or any content that sexually exploits minors is not handled through DMCA. Such content is reported directly to the **National Center for Missing & Exploited Children (NCMEC)** as required by 18 U.S.C. § 2258A, preserved for at least one year, and results in immediate account termination. Do not use this DMCA process for CSAM — email [legal@gri.tt](mailto:legal@gri.tt) or report directly to NCMEC's CyberTipline.

## Misrepresentation warning

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that content is infringing, or that content was removed by mistake, may be liable for damages, including costs and attorneys' fees. Only submit a takedown notice if you have a genuine, good-faith belief that infringement has occurred.
